Terms and conditions of sale (february 2012)

The following terms and conditions of sale apply between, on the one hand, the company “Clin d’œil SARL”, with a capital of €50000, whose head office is located in LYON (69008) and incorporated at the Companies House of Lyon with under number 453 470 585, hereinafter named « VOTRECHAPEAU.COM » and, on the other hand, any person or entity wishing to make a purchase, via the website www.votrechapeau.com, hereinafter designated as the “buyer”.

Purpose:

These terms & conditions shall define the contractual relationship between the buyer and “Clin d’oeil SARL”, as well as the conditions applicable to any purchase made through the webshop www.votrechapeau.com by the buyer, regardless he is a professional or not.

The purchase of a product through this website implies the full acceptance by the buyer of these terms & conditions.

These terms & conditions shall prevail over any other general or special conditions not specifically approved by www.votrechapeau.com. www.votrechapeau.com reserves the right to modify its sales terms & conditions at any time. In this case, the applicable conditions will be the ones in effect at the date of the order by the buyer.

Features of the proposed goods:

Offered products are those listed on the catalog published on the website www.votrechapeau.com.

 The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product, especially with regard to color.

Pricing:

Prices listed on the website are all taxes included, in euro (€). The prices listed do not include shipping and delivery fees.

www.votrechapeau.com reserves the right to change prices at any time, provided that the price displayed at the day of an order shall be applicable to the buyer for this order.

We can accept your orders within the limit of available stocks. In the case of a payment by check or bank transfer, your order will only be processed once payment is received and delivery times are applicable at the date of the payment receipt.

If, by mistake, unavailable products appear online, www.votrechapeau.com will keep the buyer posted, by email, in the shortest possible time.

In case of unavailability in the indicated delivery time, www.votrechapeau.com reserves the right to propose a substitute item with the equivalent features (price, quality) as the ordered product. In the case www.votrechapeau.com would not be able to provide an equivalent item or if the buyer does not desire this equivalent item, the buyer will be able to cancel his order.

 In case of permanent unavailability, and if V cannot provide an equivalent item, the order will be automatically cancelled.

Geographical area:

The online sale of the products listed on the website is reserved to buyers residing in Metropolitan France and for deliveries required in Metropolitan France. For delivery in Europe or in the rest of the world, thank you for contacting us.

Order:

This commercial website addresses to our business customers, hat shops, hat specialists as well as private individuals.

• For business customers:

They will be able to know our products through our website. If you contact us for the first time, thank you for sending us by email your name and address as well as your Company Trade Registration number. You will then receive our rates and terms of sale.

• For private individuals :

You can directly place an order on the website after creating a customer account.

Withdrawal:

The buyers, non-professional individuals, qualify for a seven days withdrawal period from the date of delivery of their order to return the product to the seller for exchange or refund without penalty, except for the shipping costs.

Terms of payment:

Payment is required upon order (credit card, check and bank transfer accepted).

Payment by check is only available for checks in Euros issued in a French bank. You will have to make the check payable to “Clin d’oeil SARL” and send it to the following address: Clin d’oeil SARL - 3 rue Varichon - 69008 LYON. The check will be cashed upon receipt.

In case of payment delay, votrechapeau.com reserves the right to claim for late penalty fees calculated on the basis of the legal rate in force and applicable at the date of the order to pay.

Deliveries:

Deliveries are made to the address specified in the order form which can only be in the geographical area agreed.

Risks are at the buyer’s expense from the moment the products have left the premises of V.

In case of damage during shipping, any protest will be addressed to the carrier by making a statement on the delivery order.
